Terms of Service
1. Definitions
"Racketeer", "the Software", "we", "us", or "our" refers to the Racketeer rack documentation application and its operator. "You" or "Customer" refers to the individual or organisation that has purchased or is evaluating the Software. "License" means the right to use the Software as granted by a valid license key.
2. License Grant
Subject to payment of the applicable license fee and compliance with these terms, we grant you a non-exclusive, non-transferable license to:
- Install and run the Software on systems you own or control, within the seat and site limits of your license tier.
- Use the Software for your internal business purposes.
- Create and retain documentation, PDF exports, and reports generated by the Software.
This license does not grant you ownership of the Software. All intellectual property rights in the Software remain with us.
3. Permitted Use
You may use Racketeer to:
- Document rack layouts, devices, ports, and connections for your own or your clients' infrastructure.
- Generate reports and PDF exports for internal use and client delivery.
- Operate the Software on your local network for access by your team, within licensed seat limits.
4. Restrictions
You may not:
- Redistribute, resell, sublicense, or transfer the Software or your license key to third parties.
- Reverse engineer, decompile, or attempt to extract source code from the Software binary.
- Remove or circumvent license enforcement, seat limits, or feature gating mechanisms.
- Use the Software to provide a hosted service to third parties (i.e., as a multi-tenant SaaS offering) without a separate Enterprise agreement.
- Share your license key publicly or across multiple organisations.
5. License Tiers and Limits
Each license tier carries specific limits (seats, sites, racks) as described on our pricing page. Exceeding these limits may result in the Software entering read-only mode. Upgrading your license tier is available at any time by purchasing an upgrade.
Beta licenses issued for evaluation purposes are time-limited and may include reduced functionality restrictions at the end of the beta period.
6. Updates and Support
Active licenses include access to all minor and patch updates released during the license term. Major version upgrades (e.g., v1.x → v2.x) may require a new license or upgrade fee at our discretion.
Support is provided via email at hello@racketeer.io. We aim to respond to all support requests within 2 business days. Support is provided on a reasonable-effort basis and does not include SLA guarantees on Starter or Professional plans.
7. Payment and Renewal
License fees are charged as described on the pricing page (monthly or annual). Annual licenses are billed upfront. Monthly licenses renew automatically unless cancelled.
All fees are exclusive of applicable taxes (VAT, GST, etc.). You are responsible for any taxes arising in your jurisdiction.
We reserve the right to change pricing with 30 days' notice. Existing active subscriptions will not be affected until their next renewal date.
8. Refund Policy
We offer a 14-day refund on new annual license purchases if you notify us within 14 days of purchase and have not exceeded 5 racks of active usage. Refunds are not available on monthly subscription charges that have already processed or on renewal charges. Contact hello@racketeer.io to request a refund.
9. Data and Privacy
All data you enter into the Racketeer application is stored locally on your systems and is never transmitted to us. Please refer to our Privacy Policy for information about data collected through our website and order process.
You are solely responsible for backing up your Racketeer database and for the security of the systems on which Racketeer is installed.
10. Warranty Disclaimer
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE OR UNINTERRUPTED.
Racketeer is documentation software. It does not provide compliance certification, engineering sign-off, or any professional regulatory advice. Any documentation generated is for your reference only.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE SOFTWARE SHALL NOT EXCEED THE FEES PAID BY YOU IN THE 12 MONTHS PRIOR TO THE CLAIM.
WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
12. Termination
This agreement terminates automatically if you breach any material term. On termination: your license key will cease to function at its next validation cycle; you must delete all copies of the Software from systems you control. Termination does not entitle you to a refund except as set out in section 8.
We may suspend or terminate your license immediately if we determine your use violates section 4 (Restrictions).
13. Governing Law
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory local consumer protection laws apply.
14. Changes to These Terms
We may update these terms periodically. For active subscribers, material changes will be communicated by email at least 30 days before taking effect. Continued use of the Software after the effective date constitutes acceptance of the revised terms.
